Introduction

The Terms and Conditions stated herein (collectively, the "Terms & Conditions" or this "Agreement") constitute a legal agreement between you and Indek Middle East DMCC (hereafter referred to as "the Company") applicable to the booking of Indek's 'Bag Drop' and 'Bag Storage' Services (hereafter referred to as "the Service") for requesting the collection of your luggage and transfer to the drop location by Indek or an approved logistics partner (hereafter, “the Partner”) appointed by the Company.

To access the website www.indek.ae (the "Website") or the Indek mobile application (the "Application") and use the Services defined, you must agree to the Terms of Use outlined below.

The Website and Application are owned and operated by the Company, which has its registered office in Dubai, UAE. The Terms and Conditions apply to all visitors, registered members, and users of the Website and Application.

The Company reserves the right, at any time, to modify, vary, and change the Terms of Use or its policies relating to the Service without liability to you or any third party. Modifications, variations, and/or changes to the Terms of Use or its policies relating to the Service will take effect upon the posting of an updated version on the Website.

You agree that it is your responsibility to review the Terms of Service on a regular basis and that your continued use of the Service following any such changes, whether reviewed by you, constitutes your consent and acceptance of such changes.

Please read these terms and conditions carefully. You agree that by using the Service (as defined below), you have read, understood, accepted, and agreed to the Terms of Use. If you do not agree with or fall within the Service's Terms of Use and wish to stop using the Service, please do not use the Application, Website (as defined below), or Service.

Within these conditions, and except where otherwise specified, the following terms shall have the meanings defined below:

"Airport" refers to the airport chosen by the Customer as the location for the Bag's drop-off;

"Drop Location" refers to the location chosen by the Customer as the Bag's drop-off location;

The term "Partner" refers to the authorized logistics partner chosen by the Company to transport the luggage.

The term "Application" refers to the mobile application that allows users to access and purchase Services from the Company.

"Bag" or "Baggage" or "Luggage" refers to any piece of luggage owned by (or otherwise in the care and control of) the Customer and transported by the Partner appointed by the Company in accordance with these Terms;

"Booking" refers to the Customer's request for Services;

"Baggage Collection Address" refers to the location confirmed by the Customer for Bag collection on the Indek mobile application or website at the time of Booking.

"Customer" refers to the person who creates or requests a booking for services through the Indek mobile application or website;

"Ineligible Luggage" means luggage that is overweight and oversize according to the specifications provided by the Company from time to time, and contains goods that are prohibited or restricted by customs or transport authorities (including firearms, ammunition, flammable or explosive items, and other items listed in an airline's dangerous goods list, a copy of which can be found on airline websites), or any Bags that the Company believes are unfit to be transported.

"Prohibited Items" are any items prohibited for air transportation by any regulatory or governmental body, including, without limitation, any items deemed potentially dangerous in nature, illegal possession of items, livestock, foodstuffs, and perishable items.

"Scheduled Time" refers to the agreed-upon time at which the Company can collect the baggage from the customer at the agreed-upon Customer's baggage collection address.

Accepting baggage for transfer from the Customer (or hotel reception) and transporting the bags to the airport or drop location in accordance with these Terms is referred to as "Services." The terms "we," "our," "the Company," and "us" refer to Indek.

Booking

  1. A Booking is a request submitted through the Application or Website.
  2. A Booking is only valid after the Customer accepts these Terms and Conditions and receives confirmation from the Company via the mobile application, printed confirmation, email, or manual receipt.
  3. If the Customer does not receive a confirmation notification from Us, the Booking is void.
  4. The Company reserves the right, at its sole discretion, to decline or cancel any Booking with no liability to the Customer or a third party.
  5. The Customer may cancel the Customer Booking at any time before an agent is dispatched to the Baggage Collection Address specified by the Customer. For cancellation, the Customer will be charged a booking fee.
  6. To make a Booking, you must first register and become a registered user on the Website or Application. By registering on the Website or Application, you agree to appoint the Company to provide you with the Services as defined in these Terms and as mutually agreed upon between the parties. You must provide certain information to register on the Website or Application, such as your name, business profile, content details, and funding information. Following that, you will be assigned a unique username and password.
  7. Registration is only required once, and if you have previously registered, you will log in using the same credentials that you provided during the registration process. We ask that you keep your password and account secure and that no one else has access to them. You are responsible for keeping your account information up to date.
  8. When you use the Website, you are responsible for keeping your account and password secure and restricting access to your computer, mobile device, or another similar device to prevent unauthorized access to your account. We ask that you keep your password and account secure and that no one else has access to them. It is your responsibility to maintain the accuracy of your account information.
  9. We reserve the right, at our sole discretion, to refuse access to the Website or Application, terminate accounts, and remove or edit content.
  10. We will make every effort to ensure that the Website and Application are error-free. Your access to the Website or Application may be suspended or limited from time to time to allow for repairs, maintenance, or the introduction of new features or services. We do not, however, accept responsibility for internet-related issues at your end.
  11. Indek, in accordance with its standard compensation policy, shall compensate for the missing, damaged, or lost shipment by its actual value or a maximum amount of USD 100 (at a fixed exchange rate of AED 3.65 = 1USD) - Indek Operations team will investigate first, and if it is our fleet's fault, this clause will be applied.
  12. The package will be delivered to the specified address, and the customer must provide complete contact information.
  13. If a pick-up or delivery requires a pass to be obtained in advance and payment to be made (for example, JAFZA, SAIF Zone, etc.), it is the customer's responsibility to pay and obtain the pass in time for the respective Indek driver to perform the service.
  14. Following the completion of delivery services, all outstanding payments for delivery services must be cleared.
  15. Waiting Times: In the event of a delay, Indek delivery agents will wait for a maximum of 10 minutes.
  16. Indek will not be held responsible for shipment delays caused by customer delays.
  17. Cancellations made within two hours of the scheduled pick-up time will result in full delivery charges.
  18. Rescheduling: Any orders must be rescheduled 5 hours in advance.
  19. Your contact information may be used to send you Indek service updates and promotional offers.
  20. Indek will make a maximum of two additional delivery attempts per booking. Any additional delivery attempts will result in a new delivery charge.
